Freshwater Village Shop-Top Development refused, Harbord Hotel requests rezoning review, Narrabeen and Brookvale residential apartment blocks get the go-ahead and more in this week’s Development Application Round Up

Manly Observer provides a weekly summary of development applications lodged with Northern Beaches Council in the last week.

  • Allow hotel accommodation on the site as part of the amended APU.

Late last year, Harbord Hotel submitted a planning proposal to provide hotel accommodation on the same site as the pub. While the proposal was supported by the Northern Beaches Local Planning Panel (NBLPP) and Council officers recommended proposal endorsement, in November 2024, Council resolved not to endorse the proposal. Harbord Hotel submitted a rezoning review with the Department of Planning, Housing and Infrastructure. In March this year, the Panel recommended the proposal be submitted for Gateway determination as the proposal “demonstrated strategic and site-specific merit”.

The Sydney North Planning Panel unanimously refused the demolition and construction of 30 shop-top apartments, ground floor retail and basement car parking at Freshwater.

Prior to the Panel convening, Northern Beaches Council recommended the refusal of the application.

The applicant sought consent for additional building height; however, Council and the Panel agreed the extent of additional building height was not deemed to be in accordance with the requirements of the State Environmental Planning Policy (SEPP) and was not supported.

Non-compliant building height and rear setback to the adjoining R2 Zone were also highlighted in the reports.

The Panel’s report added that the proposal had unreasonable amenity impacts on adjoining properties and insufficient information was provided to Council. There was also insufficient information provided with the application to allow for an adequate assessment of any view loss impacts on surrounding properties. Finally, the layout of some apartments were seen as unsatisfactory to ensure inter-tenancy acoustic privacy where a living room abuts a neighbour’s bedroom.

During the exhibition period, Council received 46 submissions in opposition to the development with the main issues being bulk and scale, LEP and DCP non-compliance, amenity including privacy and overshadowing, parking and traffic, construction impacts, impact on Freshwater Village including character, noise generated by waste collection and adequacy of landscaping.

The Northern Beaches Local Planning Panel approved for demolition works and construction of a residential flat building. The Panel was satisfied that the applicant’s written request seeking to justify a contravention of clause 4.3 Height of Buildings development standard was adequately addressed and demonstrated that compliance with the standards is unreasonable or unnecessary in the circumstances of the case and there was sufficient environmental planning grounds to justify the contraventions.

The DA included the demolition of the two freestanding homes and combining the lots to construct an 11 apartment residential flat building which will comprise a part two- and three-storey building with rooftop terrace (for exclusive use of Apartments 6, 7 and 11 and which includes the installation of a freestanding spa pool) erected over a single level of basement carparking.

The Northern Beaches Local Planning Panel approved the development to add a storey (four in total) with an additional 20 apartments to a previously approved DA. Both the Panel and Council found the applicant’s written request seeking to justify a contravention of clause 4.3 Height of Buildings development standard was adequately addressed. Council added the height of the development was well below the future height limit for the area under the Brookvale Structure Plan (BSP).

In 2020, a $16.5 million DA was approved by Council to redevelop the former St Vincent de Paul shop and warehouse into a three-storey apartment block with 48 apartments (40 residential apartments and eight work/live Soho style apartments with ground level retail/business activation) and three retail outlets (on the ground floor). This included three levels of basement parking with 164 car parking spaces.

The new floor incorporates 13 one-bedroom apartments, five two-bedroom apartments and two three-bedroom apartments.

The total expected development cost is $22 million.
