Residential units planned for Dee Why, Palm Beach shop-top housing altered and Queenscliff SLSC alterations approved in this week’s DA Round Up

Before we get into development applications, last week, the Northern Beaches Local Planning Panel (NBLPP) approved changes to who can approve certain building rule exceptions.

Put simply, when someone wants to build a house or a non-habitable structure like a shed (Class 1 and 10 buildings) that doesn’t comply with local building rules, someone needs to sign off on that exception. Previously, that was the Development Determination Panel. The sign-off is now moving to the Council’s CEO, who can pass down the authority to staff.

The need for sign-off kicks in when a home or shed breaks a numerical planning rule by more than 10 per cent, for example, with building height, floor space ratio, and any built-form controls.

The shift in sign-off is temporary while the three local planning laws (Warringah, Manly and Pittwater) become one (due to Council’s amalgamation) and is an attempt to streamline internal processes.

Of the units, 15 per cent will be allocated to affordable housing, which brings up the permissible height of the building to 12.35m (the design is within this limit). The developers are asking for an exemption to the floor space ratio (FSR). Typically, the FSR is 0.8:1; however, with affordable housing, this increases to 1.04:1. Building A has a FSR of 1.36:1 (30 per cent above the maximum limit) and building B has a FSR of 1.29:1 (22 per cent above the maximum limit).

The proposal is to modify DA2023/1289 which was approved at the Land and Environment Court for shop-top housing.

The proposed change is around extending a roof eave on the upper level, which sits above the building height maximum of 8.5 metres. However, the approved building already sits above the limit at 10.9 metres. The eave extension would reach 11.2 metres.

Two applications objected to the modification with concerns about views, landscaping and noise from the lift structure. Council recommended the approval of the modification, citing the changes as minor and the raised concerns as not serious enough to reject the application.

The Northern Beaches Local Planning Panel unanimously approved the application.
