The DA is a significant multi-stage residential subdivision, which involves subdividing three existing lots into 63 residential lots, one community lot and one residue lot.

Stage 1 includes the subdivision and constructing a new road, including a public road and bridge through Boundary Street, connecting to an existing road network, and installing utilities, stormwater management and landscaping.

A previous development application (N0330/16) was refused by the NSW Land and Environment Court in 2016 because it couldn’t secure adequate vehicular access. The application relied on vehicular access via an existing Right of Carriageway (ROC) through 10 Jubilee Avenue (owned by Uniting Church of Australia). However, the ROC has specific legal terms that only allow the current number of dwellings on 120 Mona Vale Road to use it, and the proposed development would have significantly increased the number of vehicles using the ROC.

If Stage 1 is approved, Stage 2 would include the construction of the 63 residential lots and would require separate development applications.

This latest application is part of a much larger residential development project that has been evolving since 2012 at 8 Forest Road (N0440/15) for 66 apartments within four residential flat buildings and 14 townhouses (a total of 81 dwellings).
