Previously approved senior housing traded in for apartments, The Palms Eatery in Terrey Hills tries for retrospective approval and more in this week’s development application round up

Manly Observer provides a weekly summary of development applications lodged with Northern Beaches Council in the last week.

With the introduction of the Low to Mid Rise Housing Policy and as the site is within 800m of Frenchs Forest town centre, a revised application has been submitted for 32 apartments (13 x two-bedroom and 19 x three-bedroom) with a basement car park for 43 cars. Four of the three-bedroom apartments will be available for seniors and people with disabilities.

The Palms Eatery Pty Ltd is a café/restaurant with a plant nursery and was first approved in 2000. A second approval was granted in 2014, to rebuild the restaurant on site following a fire.

On the 17 October 2023, Council issued a Development Control Order (EPA2023/0273 and EPA2023/0276) in relation to works carried out on the site without consent. Alterations and additions were undertaken at the restaurant. In particular, the dining area was completely demolished, and new dining areas constructed to the south and east of the kitchen, and new kitchen fit out works, including deep fryer, pizza oven and bar area. The new restaurant dining areas contained in excess of 100 seats. The additions to the restaurant and landscaping works were extended into the previously approved carpark. As a result, the number of parking spaces for the restaurant was reduced.

On the 12 April 2024 a DA (DA2024/0434) was lodged to address the matters raised in the Development Control Order but was later refused.

To address the Development Control Order and reasons for refusal in DA2024/0434, this new DA seeks approval for the following:

  1. Authorise the use of the existing restaurant structures altered (unlawfully), comprising:
    • The extension of the dining areas to the south and east of the existing building.
    • The extension to the kitchen and bar areas, including kitchen fit out works, which includes a deep fryer and pizza oven.
    • The free-standing entrance pergola.
  2. Increase the capacity of the restaurant to 100 patrons (48 approved) and allow the existing licence applying to the approved restaurant to operate with primary service authorisation.
  3. Reconfigure the car park layout to provide a minimum of 43 spaces for the restaurant and a minimum of 28 space for the plant nursery.
  4. Submit to Council the Sydney Water-approved Wastewater Management Plan, including details of the proposed connection to the existing sewer infrastructure on Myoora Road.
