The proposal to rezone Patyegarang, formerly known as Lizard Rock, for 450 homes has just been withdrawn.
“Today, the NSW Department of Planning has confirmed that the Metropolitan Local Aboriginal Land Council (MLALC) has withdrawn its Patyegarang planning proposal to rezone bushland on Morgan Road in Belrose for 450 homes,” Wakehurst MP Michael Regan shared in a statement.
“The rezoning proposal was reckless in the extreme. It would have created a bushfire trap for future residents, put firefighters at risk and destroyed over 45 rugby fields of local bushland with important biodiversity values.
“The withdrawal tells us that the Land Council couldn’t get the Rural Fire Service to agree to a proposal at the scale they wanted.
“This is a significant day for anyone who cares about the future of the Patyegarang site and for anyone who cares about the robustness of bushfire risk assessment in planning decisions about where to put new homes.”
The Patyegarang Planning Proposal sought to rezone 71 hectares of MLALC-owned land on Morgan Road, Belrose, for 450 home subdivisions in native bushland.
The Sydney North Planning Panel approved the proposal for Gateway Determination in June 2023, with a public exhibition period held between September and November 2023 that drew over 1,300 pages of community submissions.
Northern Beaches Council formally opposed the rezoning, citing the destruction of bushland, while community coalition Northern Beaches Envirolink raised concerns over impacts on flora and fauna, Aboriginal cultural heritage sites, bushfire risk, and inadequate infrastructure. Opposition also included a 12,000-signature petition presented to NSW Parliament in 2023.
Meanwhile, over in Manly Vale, McDonald’s and Northern Beaches Council were unable to reach an agreement at the Land and Environment Court as part of a conciliation conference.
The matter has been listed for hearing on 17 and 18 September 2026, on site from 9:30am.
McDonald’s lodged a DA with Northern Beaches Council in February 2025 for a 24/7 restaurant with a 15-car drive-thru at 37 Roseberry Street, Balgowlah. The current site of Seven Miles Coffee.
After almost 600 submissions objecting to the proposal, McDonald’s amended the DA in May 2025, revising signage and scaling back operating hours to 5am to midnight daily.

The Northern Beaches Local Planning Panel unanimously refused the application in July 2025.
McDonald’s appealed the refusal to the Land and Environment Court in February 2026.
A conciliation conference, the first step in that appeal, aimed at brokering an agreement between McDonald’s and the Council, was held on site on 28 May, drawing around 70 objecting residents. Six residents spoke against the proposal, citing traffic congestion, noise/light/odour pollution, anti-social behaviour, pedestrian and e-bike rider safety near two nearby high schools, and risks to emergency service access, including for the nearby Balgowlah Ambulance Station.
Finally, the Housing Delivery Authority (HDA) has recommended a development by The Salvation Army at 21 Eastbank Avenue & 8, 22 Homestead Avenue, Collaroy (locally known as the Collaroy Centre) as State Significant. The Minister has since declared the project as State Significant.
The initial plans are for senior housing with 388 independent living units, with two to three percent allocated as affordable housing and operated by The Salvation Army.
Stage 1 will include the construction of two buildings for a total of 102 units. The application will include rezoning.

While there are limited details on the application, it was noted that there is a signficant height variation. The development proposed a total height of 39m (13 storeys) where the current height of the sight is 8.5m (two storeys).
According to the NSW Rural Fire Service map zoning tool, the site is within a designated bush fire prone area.
