Manly Observer provides a weekly summary of development applications lodged with Northern Beaches Council in the last week.

The kitchen will be a single-storey building with green and white striped walls and a white roof. Three staff will work in the kitchen at any time, and existing seating areas will be used for customers. The kitchen will operate from 8am to 8pm, seven days a week, and deliveries will happen four times a week between 6am and 10pm.

The modification application is to amend DA2021/1039 which was approved by the Land and Environment Court (LEC) of NSW on 28 March 2023.

The original DA included the demolition of the existing structures and the construction of a 55-room boarding house with a manager’s room. It also included off-street parking for 24 cars, 13 motorcycles and 55 bicycles.

The modification application is to permit food preparation and cooking (installation of a microwave oven on the approved bench space) within 32 boarding rooms located in the lower building of the development.

LEC imposed restrictions on the use of the boarding rooms as self-contained units, which included limited plug-in appliances. However, in Council’s recommendations, they said the microwaves do not conflict with those conditions.

The application was referred to NBLPP as 19 submissions objected to the proposed changes. The main issues were regarding overdevelopment, inconsistency with the Court’s approval, and the nature of the approved development.

Council recommended NBLPP to approve the modification application and NBLPP unanimously approved it.

The proposed development was one of the first DAs to be submitted under the new State planning laws for Low to Mid Rise Housing. It’s for the demolition of the existing dwelling and the construction of a new residential flat building, creating three three-bedroom units across three storeys with a basement car park for six residential cars and one visitor car space.

The development application has been referred to NBLPP as it exceeds local planning rules – it’s 27.82 percent over the allowed floor space and 6.47 per cent over the height limit.

The DA justifies the above by saying the extra floor space is needed for a larger, higher density building type, the extra height is due to the sloping land, similar developments have been approved in the area, and the project meets the overall goals of the local planning rules.

Council requested some minor changes to the original DA and are now satisfied and recommend the DA for approval.

NBLPP unanimously approved the DA with conditions, including the developer must pay $26,000 in a housing and productivity contribution and cannot do any work on neighbouring properties without separate approval.
