Harbord Hotel one step closer to becoming a hotel, North Curly shops DA approved, and farewell Dee Why Seafood in this week’s Development Application Round Up

Manly Observer provides a weekly summary of development applications lodged with Northern Beaches Council in the last week.

The site is within R3 medium density zoning, and a small portion of the room and lift overrun will breach the height restrictions for the zoning to 12.7m (instead of the allowed 11m).

The Panel unanimously approved the demolition of the existing shop top housing development (where Dee Why Seafoods currently is) and construction of a four-storey shop top housing development with two ground floor retail tenancies, six apartments over Levels 1 to 3, plus 15 car parking spaces, and a loading dock.

The application included a request to exceed local planning height restrictions (which are 13m) to 14.77m which was approved by NBLPP.

Harbord Hotel, 29 – 31 Moore Road & 64 Undercliff Road, Freshwater – PEX2024/0005

The Harbord Hotel, formerly known as the Harbord Beach Hotel, proposed to develop a 37-room boutique hotel added to the back of the property, along with a swimming pool and a 72-car space basement car park. The first step in their proposal is to request to amend the Warringah Local Environmental Plan 2011 to allow hotel or motel accommodation, and pubs as additional permitted use on the site.

This was met with fierce opposition from neighbours (we covered the story in full here), and the Council did not support the proposal at its 12 March 2025 meeting.

The applicant submitted a rezoning review application was supported by the Sydney North Planning Panel.

“We welcome the Panel’s decision and look forward to taking another step toward the long-term vision for Harbord Hotel,” Glenn Piper, co-owner of the Hotel, told Manly Observer.

“Since 2020, we’ve taken a measured and considered approach to shaping the future of a place long woven into the heart of its community.

“This approval allows us to progress a plan for a small number of short-stay rooms that will strengthen Freshwater’s offering and respond to the growing need for quality accommodation on the Northern Beaches.

“Our commitment to Freshwater remains unwavering. Harbord Hotel will always be a place defined by its people, its culture and its history. We look forward to sharing more as the project progresses.”

A Development Application is currently being prepared. Once lodged, it will go through another public exhibition period where community members will have an opportunity to review the plans and provide feedback.

142 – 146 Pitt Road, North Curl Curl – DA2024/1219

Determination: Approved

Date determined: 12/12/2025

Determination Level: Land and Environment Court

Cost of Work: $11,029,036

Originally, the developers, Balito 1 Pty Ltd, sought approval for the demolition of the existing shops at North Curl Curl followed by the construction of a mixed used development with five ground-floor retail spaces and eight residential shop-top units and three ground-floor seniors housing independent living units.

This was later changed to include four ground-floor retail premises and ground and upper-level seniors housing consisting of 11 independent living units.

The main issue with the development is the variation to the local height limits – currently, the local planning laws allow for 8.5m, while the developer is asking for 11.035m.

Northern Beaches Council didn’t approve the DA within the required timeframe, so it was treated as a refusal and the developer appealed to the Land and Environment Court (LEC) – this is normal procedure.

Prior to the hearing, Council and the developer worked out terms they both accepted on 1 December 2025.

The LEC approved the development as both parties agreed to the terms and conditions of the development and the additional height was justified.

72 – 76 Willandra Road, Oxford Falls – DA2023/1932

Determination: Refused

Date determined: 27/11/2025

Determination Level: Land and Environment Court

Cost of Work: $17,337,202

Developer, Vigor Master, originally lodged this DA on 22 January 2024 for the construction of seniors housing with 26 self-contained living units with a community centre, landscaping and subdivision of the site. The main concern regarding the development was that it was to be built on bushfire-prone land.

Northern Beaches Council refused the DA, however, a Commissioner at the Land and Environment Court (LEC) approved the development in July this year (after Vigor Master appealed Council’s decision).

Council appealed the LEC decision, arguing the Commissioner made a legal error. The case centred on a confusing overlap between different environmental planning laws.

In November, Council won the appeal (meaning the development is on hold). The earlier approval of the development has been set aside and the case will go back to the original Commissioner to review all the different planning laws and, once again, decide whether or not to give the green light to the DA.

An earlier development application (DA2022/0616) was submitted in 2022 by the same developer for the construction of a seniors housing development with 36 self-contained living units, associated community centre and basement parking. This was refused by Northern Beaches Council in 2023, and while Vigor Master submitted an appeal, they later withdrew it.
